Terms & Conditions

These terms apply to your use of Tender HQ (the "Service"), an online take-off, estimating and tendering tool for tradespeople. The Service is provided by Pioneer Plumbing Co Pty Ltd ("we", "us"), a company registered in Australia. By using the Service you are contracting with Pioneer Plumbing Co Pty Ltd.

1. Acceptance

By creating an account or continuing to use the Service you agree to these terms. If you use the Service for a business, you confirm you have authority to bind that business. You must be at least 18 years old.

2. Your account

Keep your login details confidential and your account information accurate. You are responsible for all activity under your account.

3. Plans, payment and cancellation

Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled. Free trials convert to a paid plan when they end unless you cancel first. If you cancel, you keep access until the end of the period you have paid for.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are also governed by Paddle's Buyer Terms. See our refund policy.

4. Acceptable use

You must not misuse the Service. This includes:

• using it unlawfully, or for fraud or spam
• uploading content that infringes anyone's intellectual property or other rights
• interfering with its security, for example by using malware, probing, scraping, or trying to get around access limits
• reverse engineering, reselling or redistributing the Service
• using the AI features to create unlawful, deceptive or harmful content, or trying to bypass their safeguards

5. AI features

The Service uses artificial intelligence to suggest measurements, quantities, scope wording and answers. AI output can be inaccurate or incomplete. You are responsible for what you put in, for checking every output before relying on it, and for any price or tender you submit. AI output is not professional engineering, legal or financial advice. You must have the rights to any plans or content you upload. We may remove or restrict content, refuse or filter outputs, and suspend accounts that breach these terms. Rights holders can report infringing content to us, and repeated infringement leads to account termination.

6. Intellectual property

We own the Service, its software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use it while your plan is active. You keep ownership of your content and of the outputs you create. You give us a limited licence to host and process your content only to provide the Service.

7. Service level

We work to keep the Service reliable, but we do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, all implied warranties are excluded. Nothing in these terms limits your rights under the Australian Consumer Law.

8. Liability

To the extent permitted by law, our total liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential loss, such as lost profits, lost tenders or lost data. These limits do not apply to fraud, death or personal injury where the law does not allow it.

9. Suspension and termination

We may suspend or end your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. After your access ends, you can ask us to export or delete your data within 30 days.

10. General

These terms are governed by the laws of New South Wales, Australia, and its courts have jurisdiction. You may not assign these terms without our consent. We are not responsible for delays caused by events beyond our reasonable control. If we change these terms, we will post the update here.
